About Paul D. Borghesani
Paul D. Borghesani maintains both a transportation and business practice, representing businesses providing a variety of transportation services (private and for-hire motor carriers), as well as those utilizing various modes for the movement of their products (shippers). He has significant and diverse clientele in the transportation marketplace, including large for-hire and private motor carriers with operations throughout the United States, as well as manufacturers distributing products by highway, rail, and air.

In this context, Paul is well-versed in the Federal as well as state regulatory, licensing, tax and employment issues impacting the provision and/or use of commercial motor vehicles in interstate, intrastate, or foreign commerce. Representation has been provided in restructuring fleets to facilitate centralized management; contract strategies and negotiations to maximize efficiencies, minimize risk, and enhance performance in the distribution of products; and improving compliance with the Federal Motor Carrier Safety Regulations on a federal as well as state le

Professional and Business Activities
Mr. Borghesani is a member of the Elkhart County Bar Association, Indiana State Bar Association, and Transportation Lawyers Association. Paul is the co-founder and principal member of Motor Carrier Services, LLC, the latter providing file management, license, tax and advisory services to the transportation industry as well as companies utilizing various transportation modes.

In the past, Mr. Borghesani has served as: 
  • Of Counsel to the law firm of Baker & Daniels, providing transportation resources and representation for clients of the firm
  • Consultant with Morgan Drive Away, Inc. after stepping down as its Chairman and Chief Executive Officer in 1996 and growing Morgan to one of the top 100 transportation companies in the United States
  • Advisor for the Transportation Committee and Modular Housing Committee of the Manufactured Housing Institute
  • Expert witness in litigation involving transportation safety issues including driver training and responsibilities, load securement, hours of service regulations and interpretations thereof  
Mr. Borghesani has authored several articles for presentation to numerous business and professional groups as well as the Federal Motor Carrier Safety Administration, Federal Highway Administration and National Highway Traffic Administration, including, for example, compliance with the Federal Motor Carrier Safety Regulations, Wage and Hour Exemptions and Sales tax issues.

Education
Mr. Borghesani was admitted to the Massachusetts Bar in 1964 after earning a J.D. degree at the Boston College Law School and was also admitted to the Indiana Bar in 1975. He earned his B.S. degree in 1960 from Tufts University.
